Driver who caused fatal accident is provisionally released

A magistrate in Torremolinos has agreed to grant provisional release to the driver of who caused the accident in which 9 Finnish tourists died on Saturday.

The granting of provisional release is due to what are described as ‘special circumstances’. The driver, who was twice the alcohol limit, is himself in hospital and has undergone surgery for a neck injury. He is unable to move, therefore unable to go anywhere, and will not be able to participate in any preliminary legal proceedings for at least fifteen days.

Meanwhile, the Guardia Civil investigation into the accident has determined that the vehicle which caused the accident was being driven at an inappropriate speed and was performing an overtaking manoeuvre on the inside of the coach when it hit the safety barrier and then rebounded into the coach.

Thirteen of those injured when the coach overturned are still in various hospitals in the province. Seven of those who died in the accident have so far been positively identified.
