The Criminal Court Number 9 in Málaga has sentenced the former Chief of Operational Services in Nerja to 18 months in prison after he was found guilty of sexual abuse.

Sixty-three year old F.C.D was also ordered to pay €12,000 compensation to the victim, is not allowed within 500 metres of his victim at any time and for a period of two years, is disqualified from holding public office during the time of his conviction and must pay the court costs including those of the private prosecution.

The Public Prosecutor had requested an 11 month jail term with €3,000 compensation to the victim for moral damages. The private prosecution demanded a 4 year jail term, €12,000 compensation and a restraining order.

However, the ruling is not final and can be appealed to the Provincial Court of Málaga.

The incident occurred on March 9th 2006 at the municipal offices in Nerja when the defendant grabbed a member of the cleaning staff and, several times, forcibly tried to kiss her on the lips. The girl, who was 21 years old at the time, eventually managed to break free and rushed into the street for help.

The accused was immediately removed from office by the Mayor of Nerja, José Alberto Armijo, and also suspended from the local Partido Popular until such time as a judivial pronouncement was made.
