Marbella suspends demolition order

Félix Romero, PP spokesman for the government in Marbella, has announced the suspension of the decision by the Administrative Division of the Superior Court of Justice of Andalusia (TSJA) ordering the demolition of 80 homes and a four-star hotel built by Fadesa in Guadalmina.

The government wants to examine the TSJA ruling in the context of the new PGOU for Marbella, approved for the second time on July 29th and soon to be ratified by the Junta de Andalucía.

Under the new PGOU, such constructions would be legalised and, although the Council has pledged to abide by legal decisions, they believe that the ruling was made without reference to the current situation. The Council believes it would make no sense to incur the costs of demolition and compensation to owners only to then license the building of exactly the same structures on the same plots of land.
