Court orders house to be demolished

A 27 year old man from Mijas has been ordered to demolish a house where he lives with his mother after being convicted of planning violations.

The accused, a roofing contractor, received a licence to build a shed for farming implements on a plot of land classified as rural under the PGOU. Instead he built a 45 square metre house.

Under the PGOU, there is no possibility to legalise the construction and the defendant has been ordered to demolish the property within six months. He has also been handed a nine month prison sentence and a fine of €3,600.

Defence arguments that others in the area had committed the same planning violations were rejected by the court.
