Frigiliana Council has decided not to launch an appeal against the ruling of the Superior Court of Justice of Andalucia (TSJA) relating to the partially annulment of an ordinance adopted in 2004 to regulate the approval of houses built in rural areas.
The Council could appeal, and prolong the judicial process, but they believe that seven years is long enough and would now prefer to discuss the situation relating to homes built on rural land, not only relating to Frigiliana but also to other municipalities in the Axarquia.
The Council wants to see a solution to the problem of legalisation and regulation of homes built on rural land throughout the Axarquia, cleaning up the ‘mess’ once and for all.
About half of the rural homes built on rural land have already been regularised under the now-annulled ordinance.
