Junta de Andalucia approves amendment to the Domestic Trade Law

Large commercial centres in Andalucia will be permitted to open on ten public holidays per year after the Junta de Andalucia issued a decree amending the Domestic Trade Law, adhering to the minimum levels set by the Royal Decree in an apparent effort to protect small and medium-sized businesses.

The Royal Decree allows for opening on 16 public holidays but the Junta de Andalucia has opted for the minimum allowed, namely 10 days per year.

The regional decree also covers regulation of street vending and the increasingly popular ‘opportunities fairs’, these being defined as multi-sectoral events, promoted by both traders and their associations or by any public or private entity, which take place outside the usual facilities and with the aim of making sales on favourable terms for the consumer.

These fairs can last a maximum of three days, must be notified to the regional authorities thirty days in advance and must involve at least two-thirds of merchants who normally operate in the particular trade sector involved.

In addition, there can only be one such trade fair per year in any municipality or, if the fair is provincial in nature, only one per province per year.
