Court ruling in favour of Nerja Council

The Mayor of Nerja, José Alberto Armijo, has reported that the Court of Contentious Administration in Málaga has given Nerja Council the right to argue that the lands in La Coladilla set aside for a golf course were in fact developable.

According to the Mayor, in 1985 the then Provincial Environment Officer, Ignacio Trillo, ignored the legal advisers of the Junta de Andalucia and persuaded the Ministry of Environment to designate the lands as rural.

The Mayor added that the court ruling recognises that the area in question is not public forests but land belonging to the Council and developable as recorded in the PGOU (General Plan). The Council, with the permission of the Junta de Andalucia, entered into an agreement with Medgoup for the construction of a golf course, but the change of classification led to much acrimony and legal wranglings.
